Private, voluntary compliance programs, promoted by global corporations and nongovernmental organizations alike, have produced only modest and uneven improvements in working conditions and labor rights in most global supply chains. Through a detailed study of a major global apparel company and its suppliers, this article argues that this compliance model rests on misguided theoretical and empirical assumptions concerning the power of multinational corporations in global supply chains, the role information plays in shaping the behavior of key actors in these production (...) networks, and the appropriate incentives required to change behavior and promote improvements in labor standards in these emergent centers of global production. The authors argue that it is precisely these faulty assumptions and the way they have come to shape various labor compliance initiatives throughout the world—even more than a lack of commitment, resources, or transparency by global brands and their suppliers to these programs—that explain why this compliance-focused model of private voluntary regulation has not succeeded. In contrast, this article documents that a more commitment-oriented approach to improving labor standards coexists and, in many of the same factories, complements the traditional compliance model. This commitment-oriented approach, based on joint problem solving, information exchange, and the diffusion of best practices, is often obscured by the debates over traditional compliance programs but exists in myriad factories throughout the world and has led to sustained improvements in working conditions and labor rights at these workplaces. Nietzsche was a philosopher who prided himself, in deliberate contradistinction with previous philosophers, on his ‘historical sense’. But this leaves many questions unanswered about the precise role of the historical in Nietzsche’s philosophy. Perhaps most importantly, can the conception of genealogy in Nietzsche’s later philosophy, as a revised historical method, be taken to represent his mature philosophical methodology in general? I argue, firstly, that there is considerable continuity between Nietzsche’s conceptions of history in the early essay ‘On the uses and (...) disadvantages of history for life’ and those of his later philosophy. The former can therefore be used as a resource for understanding the latter. Through a reading of the early history essay I demonstrate that Nietzsche’s conception of the historical here is intimately bound up with the notion of the ‘unhistorical’ and that it is precisely renewed access to the unhistorical which is required in order for history to be conducive to the flourishing of humanity. I go on to contend that this holds for Nietzsche’s later writings as well, and that genealogy, being purely historical, must therefore be seen as one subsidiary part of a broader philosophy in which the unhistorical will play, literally, a vital role. El mayor problema es la pobreza, tanto la que surge por contingencias subjetivas y sociales como por el funcionamiento mismo de la sociedad civil: la plebe. Public pressure is essential for providing multinational enterprises (MNEs) with motivation to follow the standards of human rights conduct set in soft-law instruments, such as the United Nations Guiding Principles on Business and Human Rights. But how does the public judge MNE involvement in human rights violations? We empirically answer this question drawing on an original survey of American adults. We asked respondents to judge over 12,000 randomly generated scenarios in which MNEs may be considered to have been involved in (...) human rights violations. Our findings reveal substantial gaps between public judgments and the standards set in soft law and the normative literature. We identify the attributes of episodes of human rights violations involving MNEs that influence public judgments, including the relationship between the MNE and the perpetrator, the practice of due diligence, and the type of abuse. These results provide insights as to when we might expect public pressure to drive MNE compliance with soft-law instruments, and they direct attention to specific standards that will likely require stronger, ‘hard’ law approaches or broader efforts to shift the public’s view. De hecho, la antropología es como un cruce de caminos en el que confluyen muchas cuestiones filosóficas. El hombre mismo es una cuestión cuya complejidad extiende sus hilos a todo el campo de la filosofía. La realidad toda se entreteje en sus fibras, de ahí la caracterización renacentista del hombre como microcosmos. El carácter corporal y social, la afectividad, el lenguaje y, especialmente, (...) la mente y el carácter personal muestran de qué «material», está hecho el hombre, cómo está equipado. Otros rasgos, como identidad, libertad, actividad, historicidad, cultura y sociedad, enseñan cuál es la tarea a la que está destinado. Finalmente, otros indican los límites en los que discurre su existencia y ayudan a trazar los perfiles: el mal, la caída, la culpa y la muerte. Estos límites reflejan, además, una experiencia muy actual: el carácter vulnerable del hombre. (shrink)

The concept of experience, in Kant as well as in Hegel, as well as the process of tansformation it undergoes in passing from one philosopher to the other, offers a great complexity. Here, we will take up in only one aspect, though not in the least marginal I believe; that is, experience as constituent, as an element or process constituent of the subject , so that experience itself conforms the set of possibilility conditions for the opening up to the world (...) and the realization of new experiences, and even more, the set which determines this opening and the experience. With it, in that transformation, not only the transformation of the modern concept of experience is produced, but also the field in which the concept of experience in contemporary philosophy is to be discussed is as well indicated, even though, in this case, it might be translated into other terms, such as self, subjectivity, existence, personal identity, narrative identity, etc.El concepto de experiencia, tanto en Kant como en Hegel así como en el proceso de transformación que sufre con el paso de uno al otro, ofrece una gran complejidad. Aquí vamos a centrarnos en un solo aspecto, creo que nada marginal, a saber, la experiencia como constitutivo, como elemento o proceso constituyente del sujeto , de forma que ella misma conforma el conjunto de condiciones de posibilidad para la apertura al mundo y la realización de nuevas experiencias, es más, es el conjunto que determina dicha apertura y la experiencia. Con ello, en dicha transformación no sólo se produce la transformación del concepto moderno de experiencia, sino que se señala el campo en el que se va a debatir el concepto de experiencia en la filosofía contemporánea, aunque en este caso se traduzca en otros términos, tales como sí-mismo, subjetividad, existencia, identidad personal, identidad narrativa, etc. (shrink)

Environmental regulation in middle-income and developing countries is often viewed with high degrees of pessimism. Although many countries have adopted protective laws, violations are widespread and institutions are weak. This paper analyzes the puzzle of shifting patterns of environmental regulation in Argentina, a country with widespread institutional weakness. Most regulators in Argentina take a firefighting approach, acting only when skirmishes emerge between communities and firms. Amidst regulatory chaos, improvements in the environmental performance of firms are few, and noncompliance remains the (...) norm. However, in the province of Tucumán, the pattern of regulation shifted, and officials began to systematically enforce regulations. This paper traces shifts in patterns of enforcement back to broad pressures that provoked industry and environmentalists to support increases in the internal and external components of state regulatory capacity. The analysis uncovers political dynamics that can contribute to strengthening the institutions necessary for sustainable development. (shrink)

When I say ‘pain’, it is clearly a singular phenomenon. Yet if I ask for an example, you can provide many varying instances that confound the idea of its singularity. How can a pinprick be of the same thing as depression or grief? This study maintains the singularity of pain by exploring the process and structure of its experience to account for its variance and its subjectivity. Heidegger’s Being and Time provides the pathway to achieving this, where we comprehend how (...) pain’s myriad manifestations, and their inherent subjectivity, relate to our way of Being – the meaningful horizon through which we encounter pain. The study comes to tie the process of encountering pain with a structure that suffering provides, which explains both the variance and the subjectivity of the pain experience. This can then be mapped onto individual experiences of a singular phenomenon to understand how they arose and what has conditioned them. (shrink)

Benardete paradoxes involve a beginningless set each member of which satisfies some predicate just in case no earlier member satisfies it. Such paradoxes have been wielded on behalf of arguments for the impossibility of an infinite past. These arguments often deploy patchwork principles in support of their key linking premise. Here I argue that patchwork principles fail to justify this key premise.

Tomando como punto de partida la importancia de la memoria en Israel (1), se trata, en primer lugar, de la concepción del tiempo que hace posible hacer memoria (2) y qué significa memoria (3), pasando después a considerar los verbos de la memoria, es decir, los ejercicios de la memoria: recordar, rememorar, conmemorar (4). La historia recordada suele ser la de las hazañas, en cambio en Israel encontramos que la historia del dolor tiene una presencia relevante (5), cuya consideración lleva (...) a la experiencia del horror que ha sufrido en el siglo XX: Auschwitz, lo cual ha dado nuevos motivos para la memoria, incluso un mandamiento o nuevo imperativo categórico (6). A lo largo de la exposición la memoria se nos ha presentado con una fuerte dimensión teológica y también ética, de modo que en la conclusión (7) se pregunta por la relación entre ambas dimensiones. John McDowell and Hubert L. Dreyfus are philosophers of world renown, whose work has decisively shaped the fields of analytic philosophy and phenomenology respectively.
